Is the Criminal Justice System Bias Essay

Abstract This paper will ask several questions and hopefully answer most of those questions. Questions like is the criminal justice system bias against the poor and is the criminal justice system bias against minorities. We then explore some of the possible solutions to the problems that could cause biases. We then look at a study done on several communities where relations between police and the public had repaired their relationship. Body It’s easy to understand why people see the criminal justice system as biased. Our of all of our states prisoners forty percent can not even read; and sixty-seven percent did not have full-time employment when they were arrested. So there are more uneducated people in prison then there are educated people. This seems like then that our system of criminal justice is operated on an unequal system against poor or uneducated people. However, one of the problems we run into when we try to compare the wealthy lawbreakers to poor lawbreakers is the wide difference between the amount of wealthy people and poor people we have in our population. â€Å"In 1989, the wealthiest one percent of United States households owned nearly forty percent of the nation’s wealth. The wealthiest twenty percent owned more than eighty percent of the nation’s wealth. That leaves precious little for the rest† (Cole, 2000). This isn’t just true with adults, but with children and te enagers too. The number of poor/under-funded schools in America far outweighs the number of wealthy schools in America. That’s probably the main reason our system appears to be unfair against the poor. The reason that any pole or nation wide research will be bias against the poor or lower class is because there is a much larger poor/lower class population than a wealthy/high class population. Most American’s will probably not want to believe that our criminal justice system is not operated on equality. After  all our nations Supreme Court even has the saying â€Å"Equal Justice Under Law† written above the entranceway. There are several very famous Supreme Court’s decisions that uphold equality for the poor. In Gideon v. Wainwright they made it a law that the state must provide a lawyer to all defendants who have been charged with a serious crime and cannot afford a lawyer. In Miranda v. Arizona the Supreme Court decided that police must provide all suspects with an attorney. These court decisions might be a little misleading since both were decided during the time of Chief Justice Earl Warren, who was strongly liberal and very supportive of economic equality. Since then the principles of equality from both decisions for Gideon v. Wainwright and Miranda v. Arizona have been cheated and twisted so that neither decisions are upheld to the full extent that they were intended (Cole, 2000). That’s enough bashing our court system. There are actually many things that police officers do witch can be biased. For example the Fourth Amendment says that we have a right against unlawful searches and seizures. However, police officers all the time and request their consent to search them or their belongings (without ever having any basis for suspicion) without ever informing them of their right to refuse the search. This isn’t necessarily a bias against the poor but it makes sense to me that an officer would judge somebody on appearance. There is also the means of transportation we have to consider if law enforcement is bias to the poor. Say hypothetically some wealthy person is traveling across the country to a birthday party. How are they going to travel? Most wealthy people would probably travel across country like that by means of flying. While flying, people do not come in contact with that many police officers nor are they in many positions where they would normally break the law. However, say there is a poor person who is traveling the same distance to the same party but does not have the money to fly. The cheapest mode of transportation is definitely by way of buss. While traveling by buss there is definitely a larger chance of contact with the police than when traveling by air. There are also many more opportunities for crime to be committed while traveling on a buss. Again we have the situation where it’s not necessarily that the poor are treated differently but are maybe just in environments where c rime is committed more often, which would explain why it seems that the system is biased against them (Rothwax, 1996) So I feel like we could come to an  agreement now that the criminal justice system is not necessarily biased against the poor at the law enforcement side of the criminal justice system. However, the courtroom side of the criminal justice system seems indirectly biased against the poor, simply because each trial can be different depending on how much money they defense and the prosecution have available to them. Now lets talk about other ways that the criminal justice system could be bias. What about race? Are people treated differently depending on their ethnicity? Most people probably agree that there are some ethnic groups who are treated differently than other ethnic groups in the criminal justice system. Statistically minorities are disproportionately victimized by crime. â€Å"African Americans are victimized at a rate of 150 percent higher than whites† (Cole, 2000). Blacks are typically more involved in almost every kind of crime more so than whites. These crimes can include rape, aggravated assault, and armed robbery. Homicide is actually the number one leading cause of death among young black men. Most crime is interracial and so it could be argued, just as it can with the topic of biases against the poor that the reason for higher crime rates for black is because most poverty stricken areas, or the inner city, have majority black populations. Therefore the criminals would be black, the victims would be black, and all the statistics that came from that area would rate blacks more prone to commit crime than whites. Now lets look at some cases. For instance the videotaped beating of Rodney King by Los Angeles Police Department officers was a huge eye-opener for most of America. It was said of that beating that for many blacks saw that as trea tment they expected from the police. They were not surprised by that beating what so ever. Curtis Tucker, a California Assemblyman, was quoted saying at a subsequent hearing on Los Angeles Police Department practices, â€Å"When black people in Los Angeles see a police car approaching, they don’t know whether justice will be meted out or whether judge, jury, and executioner is pulling up behind them.† There was even this one officer who earned the nickname â€Å"the Mechanic† because he would â€Å"tune people up† which apparently is police slang for beating up people. This â€Å"Mechanic† once testified that the beatings were widespread. When asked the question of weather he beat up people whom he arrested he replied, â€Å"No. We just beat people up in general. If they’re on the street, hanging around drug locations. Just—It was a show of force† (Rothwax,  1996). The officer even admitted that the majority of the beating victims were either black or Hispanic; although he claimed that the attacks were not motivated by racial tension. There have been very disturbing patterns of corruption and brutality in the police force of almost every high-crime area studied. These corrupt acts include stealing from drug dealers, engaging in unlawful searches, seizures, and car stops, even dealing and using drugs. If instances like this is what our police force has come down to then our country is far worse off then I ever realized. I do however believe that this is probably a much smaller percentage than what some statistics would lead us to believe but it is not a problem that I believe can be overlooked. So what can be done? Can something be done? Are we as a country so far gone that we can come back? I believe we can. I believe that we have become to far separate from the community. We have to bridge the gap that has grown between law enforcement/the criminal justice system and the public lower class people. How do we do that? â€Å"The thing we need most is perspective† (Walker, 1980). One thing that could be the answer to our problem is community based policing. In Canada they passed the Police Services Act of 1990 that might be a good refere nce for our current agencies to look back on. What the Police Services Act did was make the Chief of Police responsible for community-oriented policing (Kuck, 2004). â€Å"Community based policing is both a philosophy and an organizational strategy that allows the police and community to work together in new ways to solve problems of crime, disorder and safety. It really only has two elements: changing the methods and practice of the police and taking steps to establish a relationship between the police and the public† (Groenewald, 2004). The Philosophy of community based policing is based off of the idea that the public has a right to give their input on policing. It also relies on the idea that to find a solution for community problems both the police and the public must look past individual crimes and incidents, and instead try to find ways of confronting the more important community problems. What does community based policing look like though? Community based police officers need to be much more than mere crime fighters and must be public servants in many ways. Reforming the police alone, however, is not enough. Community support and assistance are also necessary. Community based policing therefore encompasses strategies to reorient the public who, for  good reasons, have been leery and distrustful of the police. Building partnerships between the police and communities is a major challenge that not many people or organizations have every really attempted. The philosophy of community based policing asks both the police and the public to take a leap of faith and a commitment to change. It would be a long process that would require drastic action to be taken at multiple levels meaning that there would be detailed planning necessary to turn philosophy into reality within the police and among the public. There was a study where Kuotsia Tom Liou from the University of Central Florida and Eugene G. Savage from Florida State University looked at the impact of community policing by looking at three neighborhoods in West Palm Beach, Florida before and after the implementation of a community oriented policing program. Lets take a look at what they found. They had 3 communities with the first consisting of mainly white residents, mainly single-family homes, apartments, and small businesses. The second community was primarily black consisting of a concentrated public housing project, single family homes, apartments, small businesses, several churches, and a public middle school. The last community consisted of whites, Hispanics, blacks, and Haitians. The community was made up of single family homes, apartments, small businesses, and several churches. It was their goal to find out how community policing affects difference types of communities. The results of their study showed that after the community based policing had been going on sixty-eight percent of surveyed citizens felt that crime had decreased. All age groups, race groups, and all three neighborhoods shared the belief that crime had decreased. Even if the crime rates had not gone down in reality it would still really help relations with police officers just that the citizens believe it had. In addition to the feeling like crime had gone down they also asked in their survey how they felt about the relationship after six months of the community policing. Among the respondents to the survey eighty-eight percent felt that the relationship between the police and their communities as getting better. We started this paper with the question of is the criminal justice system bias. We talked about the relationship between law enforcement and the public. We talked about one of the possibilities of how we could rebuild that relationship. We then looked at some research where a relationship was made better by use of community policing.  Hopefully we can use research like this to help make this world a more perfect world. The Horse Dealer’s Daughter

This presentation reviews the short story, â€Å"The Horse Dealer's Daughter,† written by D. H. Lawrence. What appears to be a desperate situation in Mabel's life turns out to be a moment of epiphany between her and Fergusson when they both realize that they have stumbled upon love inadvertently. It took life teetering on the edge to force them out of their routines to see each other in a different way. ?Animals the three sons and daughter of the horse dealer are compared to animals (mainly dogs and horses); the older brother, Joe, is described as a â€Å"subject animal† that is about to â€Å"marry and go into harness,† on the other hand, Fred Henry thinks of himself as an â€Å"animal which controls,† Mabel is named † bull-dog† by her brothers. ?They are all represented by the narrator through an imagery of four horses having no sense of direction and walking in a movement that â€Å"showed a massive, slumberous strength, and a stupidity whi ch held them in subjection. † ? Writer describes the physical attributes of the characters ? Inability of both the family and the horses to intelligently respond to situations which bewilder them and over which they have no control. ?Pond ?This drowning in the pond represents the summit of Mabel's depression and confusion. The rescue, on the other hand, represents a second chance to her. ?Dead and cold. ?Dr. Fergusson had no feelings for Mabel before the incident. The narrator describes the pond as lifeless right before the doctor had entered it. Before going in, the relationship between them was dead and cold, and they had no passionate feelings for one another. Dr. Fergusson tries to rescue Mabel for no other reason but because he was doing his job. The pond also describes Dr. Fergusson's life as dull and pointless. His life was still and silent before he had met her. ?He was afraid to go in too deep into the pond, and was afraid of drowning. This represents his fear of falling in love. He was scared of the water because he could not swim, and also because he was scared of love. He never experienced it, so it frightened him. When he finally falls in, he felt Mabel's clothing and pulled her up. This means that when he fell into the pond, he found love. ?Clothes When she is out of the wet and dirty clothes, she is freed from her troubles. The dirty clothes represent how she was before she fell in love. It also represents how she was suicidal and depressed. â€Å"She had on her best dress of black voile,† expresses her happiness and eagerness to start something new. Before she fell in love, she never wore clothing as elegant as this dress. This is something new to her and something she wants to try out. Her change of clothes also represents her change of personality and attitude. She changed from a quiet woman that always kept to herself, to a loving woman that is open- minded. She now feels that there is something to live for since there is someone to love. ?Jack, in saving her life, is bound to Mabel through saving her and this is amplified by his removing her clothes and rubbing her dry. Lawrence exhibits Mabel's life as cold, void, and depressed. Comfort was found in tending the grave of her mother. Mabel was emotionally dead. Jack Ferguson lived a routine in life. Jack was spiritually dead. Perhaps Lawrence tells us that many relationships between men and women happen, perhaps without rhyme or reason or even love.

Pittsburgh – the Most Livable City!

Towns and cities have a long history. In the ancient world cities were developed in a number of regions and for a variety of reasons and motivation from religious to political views. The first true cities are sometimes considered to be large settlements where the inhabitants were no longer simply farmers of the surrounding area, but began to take on specialized occupations, and where trade, food storage and power was centralized (Gracias, par. 1). An ancient Greek philosopher, Plato, has once said, â€Å"This City is what it is because our citizens are what they are†. A city is a home for hundreds of people and is shaped by decisions, views and knowledge of those people. These days when we look up in the dictionary for the word city it is defined as a center of population, commerce, culture, and a town of significant size and importance. However, with each day cities worldwide grow, improve, and change simultaneously. Based on the technological globalization cities are moving toward becoming the centers of knowledge and learning. In fifty years from now, we will no longer view cities simply as an inhabited place of greater size, because 21st century is taking the meaning of a city to a whole new level. We will face new intelligent cities, which use technology and communication to create more efficient ways in terms of competitiveness, innovation, environment, energy, utilities, governance, and delivery of services to the citizens. Each city within our country is competing to attract more population, build a remarkable reputation and become number one. This year Forbes Magazine, the online magazine for the latest business and financial news and analysis, recognized the city of Pittsburgh as America’s Most Livable Cities for the second time (Levy, 1/2). However, as always there are many controversies about what it means to be the most livable city. Well, majority would think that livability would have to do with finding a good job. However, the word livable by itself means suitable for living. So the question is, what criteria does Forbes magazine establishes to define livable. According to the magazine it examined America’s 200 largest cities and used the following five points of data to determine the top cities: growth in income, unemployment rate, crime, cost of living, art and leisure (Levy 1/2). If you have never been to Pittsburgh, you may wonder about why in the world it was named the most livable city? Maybe twenty years ago there was nothing significant about Pittsburgh, but now there are many thriving high-tech firms that continue to form and make their mark (Florida 13/14). There are signs of life in the social and cultural environment as well. The region’s immigrant population has begun to tick upward, fed by students and professors at the universities and employees in the medical and technology sectors (13/14). There’s no doubt that Pittsburgh is one of the most livable and industrially advance cities in America. Each city possesses a unique historical and geographical background, which is what makes it significant and gives the city its sense of identity. Pittsburgh is a city known for its culture, history and accessibility. Named after William Penn the elder, the 18th century British Prime Minister, Pittsburgh was once the heart of America’s steel industry, its notorious smog earning it the nickname â€Å"hell with the lid off† (Owen, par. 1). In the late 19th and early 20th centuries, the city was home to many of America’s most successful â€Å"robber baron† industrialists, including Andrew Carnegie, Henry Clay Frick, and the Mellon brothers, as well as Henry John Heinz, the founder of the Heinz food company. In the 1970s and 80s, the city transformed its economy following the collapse of the steel industry with the healthcare and several respected universities now key employers (par. 1). In the 19th and 20th centuries, wealthy businessmen and nonprofit organizations donated millions of dollars to create educational and cultural institutions (â€Å"Pittsburgh,† pars. -5). As a result in this rich legacy of community investment and involvement, the city has built the foundation of the rich cultural and artistic environment. The 14-block Cultural District is unique and is home to the world-renowned Pittsburgh Symphony Orchestra, Pittsburgh Ballet Theatre, Pittsburgh Opera, Pittsburgh Dance Council, PNC Broadway Series, Pittsburgh Public Theater and the new August Wilson Center for African American Culture (pars. 4-5). Few cities can compare to this vibrant Cultural District alive with live theater, art and numerous restaurants. Its famous son is probably Andy Warhol, who is celebrated in an impressive museum on the city’s North Shore. The museum has achieved worldwide recognition for devoting large-scale installation art. Therefore, throughout the city and the region, galleries and museums offer everything from the cutting-edge to the classics (pars. 4-5). The entertainment is endless and the quality and variety are outstanding and fantastic. Pittsburgh has launched a multitude of programs to diversify the region’s economy away from heavy industry into high technology (Florida, 3/14). It has rebuilt its downtown virtually from scratch, invested in a new airport, and developed a massive new sport complex for its professional sport teams because of its long sport history and dedication. Pittsburgh’s football team, the Steelers, who play to a packed stadium on the Ohio River, are another example of success, and were the winners of the 2009 Super Bowl, while the ice hockey team, the Penguins, won the 2009 Stanley Cup (3/14). Indeed, Pittsburgh’s art scene, job presence, safety, and affordability make it the most livable city in the country, according to measures studied. Compared with many large cities, home prices in Pittsburgh are more affordable (Powell, par. 1). Recent surveys indicate an average home price in Pittsburgh of ranging from about $110,000 to $162,000 for a single family home, which is about 40% below the national average price (par. 1). The housing market is relatively stable despite a national subprime mortgage crisis, and Pittsburgh added jobs in 2008 even as the national economy entered a significant jobs recession. This story of regeneration was the inspiration for President Barack Obama to personally select Pittsburgh as the host city for the 2009 G20 Summit (Owen, par. 1). Pittsburgh’s strong university presence with over a dozen colleges or campuses helps encourage its livability. Because Pittsburgh is one of the largest college cities it in general has a younger, more educated and consumer-oriented population. One of its famous universities is Carnegie Mellon, one of the world’s leading centers for research in information technology (Florida, 2/14). Right down the street from Carnegie Mellon campus, is located the University of Pittsburgh, which has a world-class medical center. Pittsburgh attracts hundreds of millions of dollars per year in university research funding and is the sixth-largest center for college and university students on a per capita basis in the country (2/14). Another factor enhancing Pittsburgh’s livability is that area residents face very little risk of encountering a natural disaster, such as an earthquake, hurricane, wildfire, or tornado compared to other cities (â€Å"Improving,† 1/1). Pittsburgh is also a great place to raise a family, based on income growth over the past five years and the current unemployment rate (â€Å"Pittsburgh,† par. 6). Therefore, the city is more livable if a family’s income goes further. Pittsburgh is as well ranked among the top 10 metropolitan areas in the nation for climates favorable to business expansion (â€Å"Pittsburgh Law,† pars. 4-5). The city is one of the most industrially advanced based on technology, retail, finance, and medicine (pars. 4-5). What I mean by industrially advance is that the city is home and headquarters to major global financial institutions, including PNC Financial Services, PPG Industries, U. S. Steel, H. J. Heinz Company, CONSOL Energy, Google Corporation, and others (pars 4-5). â€Å"Our City has come a long way and I’m thrilled that Forbes. com has once again recognized Pittsburgh’s unique position as a City that truly has it all – entertainment and affordability, but most important, safety and jobs,† Pittsburgh Mayor Luke Ravenstahl said (â€Å"Pittsburgh Ranked†, 1/1). It’s important that we look to these ratings as an opportunity to not only tell our good story and attract more people and businesses to Pittsburgh, but to roll up our sleeves and work on getting even safer, creating more jobs, and being more livable (1/1). † The word â€Å"livable† carries the connotation of a place being suitable for a living. The Forbes magazine defines livable by establishing certain criteria that the city must satisfy to be recognized as America’s most livable city. Pittsburgh has outranked all 200 cities nationwide and was honored to stand out as a powerful example of what is a livable city and how to create new jobs and industries while transforming to 21st century economy. No one is claiming that Pittsburgh is a perfect city. It’s simply livable and beautiful. There’s no doubt that Pittsburgh is on the map when it comes to arts and culture , income growth, stable unemployment rate, low crime rates and average costs of living . However, there’s more about Pittsburgh than just statistics and rankings. Some people may perhaps enjoy Pittsburgh simply for its marvelous fall season. Where the nights get shorter, the wind blows brisker, and the trees shed their green, making way for coral, mustard, and flame. As you walk through dozens of neighborhoods of every stripe and character you discover that Pittsburgh feels like home. Rolling hills, wooded glens, dog walks, and unbelievable views of the sky can make you forget about all that reading you have to do for school or work. All the lists and web articles in the world can’t convince you that Pittsburgh is the most livable and perfect place, but a visit here just might.

ABSTRACT Soft drinks are playing the vital role in the market and the companies are also getting the good profits on these products. The soft drinks industry has originated in 1772. Now these drinks spread all over the world and the millions of bottles is consumed every day. Now this business is a global one and the companies are facing high competition in this business and they are changing their strategies according to the situations. Pearl Beverages Pvt. Ltd. Takes a great care to maintain quality control of products in their factory. The bottles are visually examined for impurities continuously, as the bottles move out.Samples are checked every ten minutes of production time by the chemist for its quality and hygienic condition. The chemical analysis is also flavours, gas contain and sugar percentage. The appearance, smell and taste of the production are suspended and the correcting measures are taken also as to sent right the bottling process. The main objective of the study is to find out the strength and weakness of the Pepsi in visakhapatnam zone when compared to the Coca-cola, that is mainly in the three places in Srikakulam district i. e. Srikakulam, Narasannapeta, and Amadalavalasa .Consulting almost all the outlets in these three areas, which are selling the soft drinks with a structured questionnaire, has done the study. The data has been collected and analyzed and interpreted by the help of the graphical representation technique. The analysis revels the various strengths and weaknesses of Pepsi in these areas along with the position of competitors. The most of the consumers preferred soft drinks because of better taste and to quench out their thrust. But now days, due to the changing food habits consumers have started adding the soft drinks in their food habits.The total sales of the soft drinks the Pepsi’s share is more but when compared with the Cock the number of outlets are less than Cock. Creating value and purpose for the organization is an essential part of leadership. However, creating goals and creating value is not enough; the leader must ensure that such change is sustainable. Remaining faithful to the direction set forth by an educational leader is key to the development of his or her staff (Jacobson, Johnson, Ylimaki, & Giles, 2009). Leadership can be related to the interaction between the leader and the follower. However, the numerous facets of such interaction and the intensity of the working relationship influence the outcome – accomplishing the goals set. Effective leadership can be observed when organizations develop all members’ skills and values related to organizational learning (Collinson, 2008). Many l eaders become effective due to the quality of the followers. Some researchers maintain the traditional views of a leader as a taskmaster and as one who relies on situational variables and contingency approaches produced by previous factors that guide their performance (Antelo, Henderson, & St. Clair, 2010). A transformational leader conducts him or herself in ways that are different from the convention or norms; leaders pay more attention to the needs of others, not just as elements of the workplace, but as people (Trapero & de Lozada, 2010).
